Fall 2017 Neighborhood Update
At our annual homeowner’s association meeting in April, one of the agenda items was regarding the 20+ year old association covenant and restrictions. Our neighborhood homes are selling well and at good prices. We want to continue to maintain our neighborhood growth while respect the community and protecting the home values. The board has met several times since April to update the wording of the bylaws concerning boats, trailers, trucks and campers or motor homes as mentioned in the Brittany Oaks Covenant and Restrictions.
Section 6. Outbuildings Prohibited.
No outbuilding or other detached structure of any nature or design may be erected, nor any trailers, trucks, mobile homes, boats, motor homes, buses, equipment or machinery shall ever be parked, located or otherwise maintained on any building site, parking area or street on lots hereby restricted.
As written, this prohibits different machinery that is commonly used. It was determined during the April HOA meeting and the board that items such as trailers, trucks, boats and campers needed to be better defined.
- Trucks: As written, no trucks are allowed. Believing the original interpretation was meant for semi and box delivery trucks, the new interpretation for trucks will be:
- No trucks over 1 ton.
- No semi-trucks or trailers
- No box delivery/moving trucks except for loading and unloading.
- Trailers: As written, no trailers are allowed. Believing the original interpretation was meant for semi-truck, moving or large commercial size trailers. The new interpretation for trailers will be:
- No trailers over 10ft. in length.
- Must be stored off site or in garage between October 15th – April 30th
- TO PREPARE ALL TRAILER OWNERS, THIS POLICY WILL TAKE AFFECT OCTOBER 15, 2018
- Must be parked in owner’s driveway while not being used.
- Boats: As written, no boats are allowed. We feel that this restriction needed to be clarified better to accommodate those homeowners that have boats.
- Must be stored off site or in garage between October 15th – April 30th
- TO PREPARE ALL BOAT OWNERS, THIS POLICY WILL TAKE AFFECT OCTOBER 15, 2018
- Must be parked in owner’s driveway while not being used.
- Motor Homes and Campers: As written, none are allowed. We feel that this restriction needed to be clarified better to accommodate those homeowners that have motor homes and campers.
- They are allowed on owner’s premises only for preparation and clean up.
- No storing on site or out of site if in garage.
- Must be stored off site or in garage between October 15th – April 30th
Our association does not and will not officially monitor to discover violations of the Covenant and Restrictions. We ask that you talk to your neighbor(s) prior to making a formal complaint and appreciate everyone respecting these updated definitions. We will have a dumpster available again this fall. The tentative date is October 16th. It will be monitored due to many unacceptable items placed in and around the dumpster in April. Many unwanted possessions were simply left in the church parking lot, that included paint containers that spilled out onto the ground, pink pong tables, charcoal grills and old TV’s. It will only be available for one day only to avoid this from reoccurring. Proof of residency may be asked for.
With winter approaching, it’s a good time to mention when there is inclement weather please avoid parking in the street to allow the city to properly maintain our roads. Last year, at the request of several homeowners, we looked at hiring someone for snow removal. This proved to be very costly and if residents didn’t follow KCMO requested parking policy during a snow storm, cleaning would be a waste of money. Kansas City snow policies ask that residents in subdivisions that must park in the street follow the following parking practices:
- On streets that run North/South, park vehicles on the WEST SIDE of the street.
- On streets that run East/West, park vehicles on the NORTH SIDE of the street.
It is also the responsibility of the homeowners to clean the sidewalks of snow in front of their homes as well. This provides a safe walking area for all residents.
Kansas City Brush Pickup Dates:
Residents who live in the City’s North Zone will receive collection the week beginning Nov. 13 and the week beginning Dec. 11. Please review the pickup dates, zones and rules. Any leaf and brush collection missed on the scheduled date must be reported to 311 within 24 hours. Residents can also drop off leaves and brush at one of three locations.
Reminders:
- Keep your home safe and secure by locking doors, vehicles and ensuring garage doors are closed.
- Pick up behind your pets as you walk through our neighborhood.
- Please trim trees by road of low hanging limbs that interfere with walkers/joggers and in some case cars or buses that drive in the neighborhood.
- Our next annual meeting will be held on April 17, 2018.
